TERMS AND CONDITIONS OF ELECTRONIC SERVICE PROVISION

 

These Terms and Conditions set out the rules for using the website operated at www.petersen.com.pl, for submitting enquiries and for the provision of electronic services by the Service Provider to Users.

 

§ 1. GENERAL PROVISIONS

- The owner and administrator of the website is PETERSEN ANNA WÓJCICKA, with its registered office in Łódź, ul. Warecka 37, 91-212 Łódź, entered in the Central Register and Information on Economic Activity (CEIDG), VAT No.: 7262116055, statistical No. (REGON): 363259142 (hereinafter referred to as the "Service Provider").

-  The Service Provider may be contacted by:

- The website is of an image and informational nature. It presents the Service Provider's product offering (in particular the design and manufacture of textiles for: corporate, hospitality, catering, airline, children's, pet, medical, vanlife and office sectors) and allows an enquiry to be submitted via the Contact Form.

- The information, descriptions and product photographs contained on the website do not constitute an offer within the meaning of the provisions of the Civil Code, but are merely an invitation to enter into a contract within the meaning of Article 71 of the Civil Code.

- The website is directed exclusively at Users who are entrepreneurs (B2B) within the meaning of Article 43 of the Civil Code, seeking solutions for purposes directly related to their business or professional activity.

 

§ 2. DEFINITIONS

- Website / Service - the website located at www.petersen.com.pl.

- Service Provider - PETERSEN ANNA WÓJCICKA, as identified in § 1(1) of these Terms and Conditions.

- User - a natural person conducting business activity, a legal person or an organisational unit without legal personality, using electronic services provided within the Service.

- Contact Form - an electronic service; an interactive form available in the Service that allows a User to send an enquiry directly to the Service Provider.

 

§ 3. ELECTRONICALLY PROVIDED SERVICES

- The Service Provider provides Users free of charge with the following electronic services:

  • Browsing the content of the Service and the Service Provider's product offering.
  • Providing an interactive Contact Form for the submission of enquiries.

- The agreement for the electronic provision of website browsing services is concluded at the moment the User enters the website and terminates at the moment of leaving it.

- The agreement for the provision of the Contact Form service is concluded at the moment the User begins filling in the form and terminates at the moment the message is sent or the User stops entering text and leaves the page containing the form.

- Use of the Service requires: a device with internet access, a properly configured web browser (e.g. Chrome, Firefox, Safari) and an active e-mail account - if the User wishes to use the Contact Form.

 

§ 4. ENQUIRY HANDLING AND DESIGN PROCESS

- In order to receive a tailored quotation, the User submits an enquiry via the Contact Form, providing contact details (name, e-mail address) and describing their requirements (e.g. technical specification, market references, desired product characteristics such as softness, premium quality, etc.).

-  Submitting an enquiry does not obligate either party to enter into an agreement.

- The further enquiry handling process (outside the Service, via e-mail or directly) typically involves the following stages:

  • Conceptual stage: Creating the product vision, preparing a moodboard comprising physical fabric samples, embroidery, finishings and visual inspirations.
  • Material selection and price positioning: Presenting material variants.
  • Prototyping: Producing physical prototypes (in one or more variants) intended for evaluation of construction, shape and branding, or for functional testing (including wash testing).
  • Approval and Production: After the prototype has been finally approved by the User and commercial terms agreed, the parties enter into a separate production agreement.
  • Each completed project is archived by the Service Provider in order to enable its precise quality reproduction for any repeat orders in the future.

 

§ 5. RIGHTS AND OBLIGATIONS OF THE USER

- The User is obliged to use the Service in a manner consistent with the law, good customs and these Terms and Conditions.

- It is prohibited for the User to provide unlawful content via the Contact Form, including material that infringes copyright or the personal rights of third parties.

- All graphic elements, logotypes, texts and the layout of the website constitute the intellectual property of the Service Provider and are subject to legal protection. Copying or using them without the Service Provider's consent is prohibited.

 

§ 6. LIABILITY AND COMPLAINTS

- The Service Provider exercises due diligence to ensure the continuous and trouble-free operation of the Service, but does not guarantee the absence of technical interruptions related to its maintenance.

-  In relations with Users who are not consumers (B2B), the Service Provider is liable exclusively for damage caused by wilful misconduct. Liability for lost profits is excluded.

- Complaints relating to the electronic provision of services (e.g. errors in the form's operation) should be submitted to: biuro@petersen.com.pl.

- The Service Provider processes a complaint within 14 days of receipt, sending a reply to the complainant's e-mail address.

 

§ 7. FINAL PROVISIONS

- These Terms and Conditions take effect on the date of their publication in the Service.

- The Service Provider reserves the right to amend these Terms and Conditions for valid reasons (e.g. changes in law, changes in technical infrastructure). Amendments take effect on the date of their publication and do not affect enquiries submitted before their introduction.

- Matters not regulated by these Terms and Conditions are governed by the provisions of the Civil Code and the Act on the Provision of Electronic Services.

- Any disputes arising from the use of the Service shall be resolved by the court of general jurisdiction having local jurisdiction for the Service Provider's registered office.
